I suspect this is some type of caterpillar that is eating your kale. Cabbage loopers are common pests of kale and will eat holes in the leaves. You could hand pick all that you see or spray the plants with Bonide Bt Thuricide or Captain Jack's Deadbug Brew according to the label directions. If you spray be sure to pay attention to the days from spray to harvest.
